Recently, Zhengzhou Tiei Extraction Technology Co., Ltd. (hereinafter referred to as “Tiei Extraction”) received the Civil Judgments No. (2026) Yu Zhi Min Zhong 60 and 61 from the Henan Provincial High People’s Court. The judgments dismissed the appeals filed by the opposing party and upheld the original judgments in favor of Tiei Extraction. The patent ownership dispute case involving Tiei Extraction Technology Co., Ltd., Henan Zhongke Hezhong Extraction Technology Co., Ltd., and Bai [surname withheld] has therefore reached a final victory for Tiei Extraction.

After being heard by both the court of first instance and the court of second instance, the case was decided in favor of Tiei Extraction at both levels. Following examination by both courts, it was confirmed that the third party not involved in the litigation had not participated in any research and development work related to the patents in question, and that Hezhongda Company had no evidence proving its research and development of the technologies involved in the patents. Meanwhile, the patents in question were related to the duties undertaken by Bai [surname withheld] at Tiei Extraction. Accordingly, the courts determined that the patents in question constituted employee inventions created by Bai [surname withheld] in the performance of his duties at Tiei Extraction, and that the patent rights should belong to Tiei Extraction. The judgment is a final judgment and became legally effective on September 4,
